
PVR INOX won an arbitration award of ₹1.22 crore plus costs against Victory Infraedge over a failed Gurugram mall deal. The developer must refund the security deposit with 12% interest from 2019.
PVR INOX Limited has won an arbitration award against Victory Infraedge Private Limited, with the tribunal ordering the developer to refund a security deposit plus interest and costs. The total award comes to ₹1,22,99,959, plus ₹5 lakh in arbitration costs, according to a company filing. The award was issued July 7.
The dispute started with a Letter of Intent signed in August 2018. Victory Infraedge had agreed to provide space on the fourth floor of its proposed VG-48 Mall at Sector 48, Gurugram, for a PVR INOX multiplex. PVR INOX paid ₹68.25 lakh as a refundable interest-free security deposit. The developer was supposed to hand over the premises by October 2019.
Victory Infraedge did not meet its contractual obligations, including handing over possession, PVR INOX said. PVR terminated the LOI, sent a legal notice demanding the deposit back, and then moved to arbitration.
The sole arbitrator, former Judge Justice Vinod Goel, ruled in PVR INOX's favor after reviewing pleadings, evidence, and arguments from both sides. The tribunal directed Victory Infraedge to refund the ₹68.25 lakh deposit. It also awarded ₹54,74,959 in interest at 12% per annum, calculated from November 1, 2019, through the date of the award. If the developer does not pay within 60 days, future interest at 12% per annum will apply.
On the interest question, the tribunal held that even though the LOI called the deposit "interest-free," PVR INOX was entitled to interest from the date of default after Victory Infraedge failed to meet its obligations and did not return the money.
