Luigi Mangione will appear in court Wednesday instead of Tuesday, after a paperwork error pushed back the latest hearing in his state murder case.
"Mistakes happen. People make mistakes," defense attorney Karen Agnifilo said Tuesday after the postponement, CBS News reported. Prosecutors took responsibility for the delay.
Mangione faces state and federal charges in the December 2024 shooting death of Brian Thompson, the UnitedHealthcare CEO. He has pleaded not guilty.
The purpose of Wednesday's hearing remains unclear. Judge Gregory Carro set it earlier in June, during a June 3 conference he closed to the public and press at the defense's request, without providing a reason for the closure, ABC News reported.
"Both sides should be working on a questionnaire for jury selection," Carro said Tuesday, according to ABC News reporting.
Mangione's state trial is expected to start Sept. 8. The judge ruled in May that the police search of Mangione was "improper" and "warrantless," suppressing some items found in a backpack with the suspect. A gun and notebook later discovered in a search of the backpack at a police station will be allowed as evidence.
The federal judge in the separate case has already ruled the backpack evidence admissible. Mangione is expected to stand trial on the federal charges in 2027.
