Belo Sun Mining Corp. said a Brazilian federal public defender's office filed a new civil action against its local subsidiary, seeking to suspend licenses for the Volta Grande gold project until the Mebêngôkre-Xikrin people are formally consulted.
The Toronto-based company, which trades on the TSX and OTCQB under BSX and BSXGF, said the action is substantially identical to an earlier case and should be dismissed under Brazilian procedural law. The Federal Public Defender's Office also named FUNAI, Brazil's indigenous affairs agency, and the state of Pará as defendants.
The lawsuit asks a court to order free, prior and informed consultation under International Labour Organization Convention No. 169, a standard Brazil has ratified. It also requests interim relief halting the project's environmental licenses and court-supervised expert evidence on the tailings dam. The claimant seeks collective moral damages of at least BRL 1 million from each defendant for the indigenous community.
Belo Sun said the claims lack merit and have been addressed in prior rulings. The company said it will defend its position.
Separately, the potential inclusion of additional indigenous groups is being discussed with FUNAI in conciliation proceedings before the TRF-1, the federal appellate court for the region. Under the framework agreed in those talks, any inclusion must rest on technical criteria and supporting assessments.
The Volta Grande project is one of several large gold deposits in Brazil's mineral-rich Pará state. Belo Sun has faced legal challenges over indigenous consultation for years. The company's BSX stock page shows an Alpha Score of 28 out of 100, reflecting the legal overhang and project-stage risk.
