ASIC extended its no-action position for digital asset firms to Sept 30, 2026, giving three more months to secure AFS licences before the new framework takes effect in April 2027.
Australia's corporate regulator has given crypto companies a longer runway to get licensed. ASIC extended its no-action position for digital asset businesses from June 30 to September 30, 2026. Firms actively working toward an Australian Financial Services (AFS) licence will not face enforcement action under the Corporations Act in the meantime.
The relief applies to businesses applying for an AFS licence or an Australian Market Licence. It also covers companies operating under authorised representative arrangements with existing AFS licence holders. Clearing and Settlement facility licences are included too.
ASIC has received about 30 licence applications from digital asset firms to date, the regulator said.
The original no-action period was set after an October 2025 update to Information Sheet 225, often called INFO 225. That document clarified how digital assets are classified as financial products. Following industry feedback, ASIC expanded INFO 225 to include stablecoins and tokenised securities.
Australia is building a new statutory framework for digital assets. The Corporations Amendment (Digital Assets Framework) Act 2026 is expected to take effect in April 2027. That legislation will formalise how digital assets fit into the country's financial rules.
The gap between the September 2026 non-action deadline and the April 2027 law creates an awkward window. Firms that do not secure a licence by September could theoretically face enforcement while the rules are still being finalised.
The stablecoin and tokenised securities classifications in INFO 225 are the categories institutional investors care about most. The licensing decisions made between now and September will determine which companies are able to serve those clients when the new framework starts.
The next milestone is April 2027, when the Digital Assets Framework Act comes into force.
